  1. ‘Tax Compliance (Amendment) Certificate Bill 2016’

First Reading 20th December 2016

The Bill seeks to amend the Tax Compliance Certificate Act (Cap. 17.25) (“the Act”).  Clause 3 of the Bill amends section 2 of the Act by deleting and replacing the definition of “Tax Compliance Certificate” and inserting definitions for “Income and Corporation Tax Act”, “Property Tax Act” and “Social Security Act”. Clause 4 of the Bill restructures and simplifies section 3 of the Act.  Clause 5 of the Bill amends section 4(b) of the Act by replacing “the prescribed fee” with “a fee of $20”. Clause 6 of the Bill deletes and replaces section 5 of the Act which specifies who is entitled to a Tax Compliance Certificate for a period of one year and who will be  granted a Tax Compliance Certificate for a period of three months. Clause 7 of the Bill updates Form 1 (Application for Tax Compliance Certificate) and Form 2 (Tax Compliance Certificate) in the First Schedule to the Act.  Clause 8 repeals the Second Schedule to the Act.

  1. ‘Conservation and Environmental Management (Amendment) Bill 2016’

First Reading 20th December 2016

The Bill seeks to amend the Conservation and Environmental Management Act 2014 (No. 17 of 2014) to incorporate consequential amendments that apply on the enactment of the Trade in Endangered Species Act 2016.

Clause 3 provides a definition for “Trade in Endangered Species Act”.  Clause 4 of the Bill amends section 12 of the Act. The amendment to section 12(2) extends the Director’s power to delegate to powers conferred and duties imposed under any other enactment.  Clause 5 of the Bill amends 79 of the Act. To allow for the testing of specimens covered under the Trade in Endangered Species Act 2016 at a scientific laboratory designated for the purpose by the Governor acting under the advice of Cabinet, and for the admissibility of the results of such tests as evidence in proceedings.
